Terms of service
These Terms of Service ("Terms") govern your access to and use of the website, applications, and
related services offered under the name PrivateBeeswax (collectively, the "Service") provided by
VectorBrains LLC, a North Carolina limited liability company with its principal place of business in Matthews,
North Carolina, United States ("VectorBrains," "we," "us," or "our"). By
accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
PrivateBeeswax provides tools that allow you to interact with an artificial intelligence ("AI")
assistant. Features may include account registration, virtual "coins" or credits used to access AI
features, and optional in-app purchases. We may modify, suspend, or discontinue any part of the Service at any
time, with or without notice, subject to applicable law.
2. Eligibility and accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are
responsible for providing accurate registration information and for safeguarding your credentials. You are
responsible for all activity under your account. Notify us promptly at the contact below if you believe your
account has been compromised.
3. Virtual coins and payments
Coins or similar credits are a limited license to use the Service's AI features, not currency, property,
or a stored-value instrument. They are non-transferable except as we expressly allow. Pricing, rates, and coin
consumption (including per-request limits tied to estimated token usage) may change. Purchases may be processed
by third party payment providers; their terms and privacy practices also apply. Except where required by law,
all fees are non-refundable. Refunds are not available for purchases of virtual coins or credits after the
purchase has completed. We may refuse or reverse transactions that appear fraudulent or abusive.
Service interruptions and AI availability
To the maximum extent permitted by applicable law, VectorBrains (including VectorBrains LLC), its affiliates,
members, managers, employees, contractors, and any operators, administrators, or service providers of the
website or the Service (collectively, the "VectorBrains Parties") are not liable for any loss,
damage, inconvenience, inability to use the Service, loss of access to AI features, inability to complete
requests, or loss of unused coins or credits during an outage, arising from or related to unforeseen
disconnection or unavailability of the AI, denial-of-service conditions, downtime, scheduled or emergency
maintenance, failures or changes by third party AI or hosting providers, network or internet outages, force
majeure, or similar service interruptions. You agree that fees and purchases are not refundable, and you are not
entitled to pro-rated credits or other compensation, solely because of such interruptions, except where a refund
or remedy is required by applicable law.
Subscriptions and unauthorized account access
If you purchase a monthly or recurring subscription, you authorize charges at the then-current rate until you
cancel. Coins or credits included with a subscription are delivered as described in the product (for example, at
the start of each billing period). You may cancel as disclosed in the Service; cancellation generally takes
effect at the end of the current billing period unless we state otherwise. Third party payment processors'
terms and practices also apply.
You are responsible for safeguarding your account credentials and devices. To the maximum extent permitted by
applicable law, VectorBrains (including VectorBrains LLC of Matthews, North Carolina, United States) is not
liable for losses arising from unauthorized access to your account, account takeover, credential theft,
phishing, malware on your devices, or similar events attributable to factors outside our reasonable control,
including misuse of your account by third parties who obtain your credentials. This includes loss of coins,
credits, data, or purchases tied to a compromised account, except where liability cannot be excluded under
applicable law. You agree to notify us promptly if you suspect unauthorized use.
4. Your content and how the Service works
You retain ownership of content you submit ("User Content"). To operate the Service, you grant
VectorBrains a worldwide, non-exclusive, royalty-free license to use, reproduce, process, transmit, and display
User Content solely as reasonably necessary to provide, secure, and improve the Service and to comply with law.
Depending on product behavior, portions of your conversation may be stored on your device and/or transmitted to
our servers to generate AI responses. Our systems may forward prompts and related context to third party AI
providers (for example, model hosts) to produce outputs. You represent that you have all rights necessary to
submit User Content and that it does not violate these Terms or applicable law.
Forum messages: content posted in forum channels may be
automatically and permanently deleted after approximately thirty (30) days as part of routine
server maintenance. Deleted forum content is not recoverable. If you need a long-term record,
keep your own copy outside the Service.
5. AI outputs and no professional advice
Outputs are generated by machine learning systems and may be incorrect, incomplete, biased, or harmful. The
Service does not provide legal, medical, financial, or other professional advice. You are solely responsible for
how you use outputs. Do not rely on the Service for high-risk decisions.
6. Acceptable use
You agree not to:
- Violate any law or infringe others' rights;
-
Submit unlawful, defamatory, harassing, fraudulent, hateful, or sexually exploitative content, or content that
violates privacy or intellectual property rights;
-
Attempt to manipulate, bypass, or override safety controls or usage restrictions, including through prompt
injection, indirect prompt injection, jailbreaks, or attempts to induce the AI to reveal system prompts,
hidden instructions, internal policies, non-public configuration, or model/provider details;
-
Attempt to probe, scan, or test the vulnerability of the Service, bypass security, or access data or accounts
you are not authorized to access;
-
Reverse engineer, decompile, or attempt to extract models or non-public APIs except where prohibited by law;
-
Use the Service to develop competing models or services in violation of our technical restrictions, or to
generate malware, spam, or disinformation at scale;
- Resell, sublicense, or commercially redistribute the Service without our written consent;
-
Use automated means in a way that imposes an unreasonable load on the Service or circumvents rate limits or
billing.
We may investigate and suspend or terminate access for violations or for any other reason, including risk to
users, third parties, or our operations.
7. Intellectual property
The Service, including software, branding, documentation, and our proprietary materials, is owned by
VectorBrains and its licensors and is protected by intellectual property laws. Except for the limited rights
expressly granted in these Terms, we reserve all rights.
8. Third party services
The Service may integrate with or depend on third parties (including AI model providers, hosting providers, and
payment processors). We are not responsible for third party services, and your use of them may be subject to
their terms.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER
EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR
SECURE, OR THAT AI OUTPUTS WILL BE ACCURATE OR RELIABLE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL VECTORBRAINS, ITS MEMBERS, MANAGERS,
EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,
EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT
OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE
LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF
(A) THE AMOUNTS YOU PAID TO VECTORBRAINS FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE
HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
11. Indemnity
You will defend, indemnify, and hold harmless VectorBrains and its members, managers, employees, contractors, and
affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable
attorneys' fees) arising out of or related to your User Content, your use of the Service, your violation
of these Terms, or your violation of any law or third party rights.
12. Dispute resolution; governing law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law
principles, except that the U.S. Federal Arbitration Act may govern arbitration where applicable. You agree
that exclusive jurisdiction and venue for any dispute arising out of these Terms or the Service will lie in the
state or federal courts located in Mecklenburg County, North Carolina, and you consent to personal jurisdiction
there. If you are a consumer, you may have additional rights under the laws of your place of residence where
those laws cannot be waived.
13. Changes
We may update these Terms at any time by posting a revised version on the Service and updating the effective
date. You agree that we may modify these Terms without prior notice to you, except where applicable law requires
notice, consent, or a different process for changes to apply.
Where the law requires reasonable or advance notice for material changes, we will provide such notice only to
the extent required. Your continued use of the Service after the revised Terms are posted constitutes your
acceptance of the revised Terms. If you do not agree, you must stop using the Service.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access for any reason, including
breach of these Terms. Provisions that by their nature should survive (including ownership, disclaimers,
limitations of liability, indemnity, and governing law) will survive termination.
15. Miscellaneous
These Terms constitute the entire agreement between you and VectorBrains regarding the Service and supersede
prior understandings on the subject. If any provision is held invalid, the remaining provisions remain in
effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent;
we may assign them in connection with a merger, acquisition, or sale of assets.
Privacy policy
This Privacy Policy describes how VectorBrains LLC ("VectorBrains," "we," "us")
collects, uses, and shares information in connection with PrivateBeeswax (the "Service"). By using
the Service, you agree to this policy. If you do not agree, do not use the Service.
1. Information we collect
We may collect:
-
Account and profile data: such as name, email address, and credentials you provide when you
register or sign in.
-
Service usage data: such as authentication events, coin balances and deductions, request
metadata needed to operate billing and abuse prevention, and technical information (for example, IP address,
device/browser type, and timestamps).
-
Content you submit for AI processing: when you send a message, your prompts and conversation
context you choose to transmit are processed by our systems and may be sent to third party AI model providers
to generate a response, as described in our Terms and in product disclosures.
-
Payment information: payments are typically handled by third party processors; we may receive
limited transaction details (such as confirmation, amount, and non-sensitive identifiers) but not your full
card number where the processor tokenizes payment data.
2. How we use information
We use information to:
- Provide, maintain, secure, and improve the Service;
- Authenticate users, prevent fraud and abuse, and enforce our Terms;
- Process coin purchases and usage-based billing;
- Communicate with you about the Service (for example, security or transactional notices);
- Comply with legal obligations and respond to lawful requests.
We do not sell your personal information as that term is commonly defined in U.S. state privacy laws. We do
not use your content to train third party foundation models except as dictated by the applicable AI
provider's policies and our agreements with them; you should review those providers' documentation
for their retention and training practices.
3. How we share information
We may share information with:
-
Service providers who assist us (for example, hosting, analytics, security, email delivery, and
payment processing), subject to confidentiality and processing obligations.
-
AI infrastructure providers that process prompts and generate responses on our behalf.
-
Legal and safety recipients when we believe disclosure is required by law, regulation, legal
process, or governmental request, or to protect the rights, property, or safety of VectorBrains, our users, or
others.
-
Business transfers in connection with a merger, acquisition, financing, or sale of assets,
subject to appropriate safeguards.
4. Storage, retention, and security
We retain information for as long as necessary to provide the Service, comply with law, resolve disputes, and
enforce our agreements. Retention periods vary by data category. Depending on product design, conversation
history may persist primarily on your device; server-side components may retain minimal data needed for
accounts, billing, security logs, and lawful operations. We implement reasonable administrative, technical, and
organizational measures designed to protect information; no method of transmission or storage is completely
secure.
Forum channels: messages in forum channels are subject to
automatic deletion after about 30 days on our servers. Such deletions are
permanent and not restorable.
5. Cookies and similar technologies
We and our providers may use cookies, local storage, and similar technologies for authentication, preferences,
security, and Service functionality. You can control some technologies through your browser settings.
6. Your choices and rights
Depending on where you live, you may have rights to access, correct, delete, or restrict certain personal
information, or to object to or opt out of certain processing. You may exercise applicable rights by contacting
us using the information below. We will respond consistent with applicable law. You may also have the right to
lodge a complaint with a supervisory authority in your jurisdiction.
7. Children
The Service is not directed to children under 13, and we do not knowingly collect personal information from
children under 13. If you believe we have collected such information, contact us and we will take appropriate
steps to delete it.
8. International users
If you access the Service from outside the United States, you understand that your information may be processed
in the United States and other countries where we or our providers operate, which may have different data
protection rules than your country.
9. Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated policy and revise the effective
date. Where required, we will provide additional notice.
